Allan Nackan Organizes US-Canadian Cross Border Panel in Toronto

Allan Nackan CPA, CA, CAIRP of Farber Financial Group in Toronto recently co-chaired the Commercial List Users Committee Annual Golf Day and Education Retreat. This is an important annual event for the Toronto insolvency & restructuring community. It was well-attended by many of the Commercial List Judges, members of the Toronto insolvency bar and the financial advisory/accounting community.

Allan put together a cross-border panel which included: Justice Frank Newbould as moderator; Hon. James M. Peck of Morrison Foster LLP; James H.M. Sprayregen of Kirkland & Ellis LLP and current president of INSOL International; Elizabeth Pillon of Stikeman Elliot LLP and Philip Reynolds of KPMG LLP.

Discussion topics included:

  • Lessons learned from Lehman Brothers, the largest Bankruptcy in US history, and how the cross border protocol facilitated the development of a consensual plan.
  • Recent Chapter 15 developments and cases including: Morning Mist, Drawbridge, Jaffe v Samsung, and In re. Vitro.
  • Increased involvement of distressed investors in insolvency proceedings and how that impacts the dynamics of a case.
  • Examining the evolution of the role of the Information Officer in Canadian CCAA proceedings, its effectiveness and challenges in practically implementing the role.

The seminar was a great success and the cross-border panel and speakers received a lot of interest.
